General Terms and Conditions (GTC) for theboatsmarket.com

1. General Provisions

1.1. Subject

These General Terms and Conditions (hereinafter referred to as 'GTC') govern the relationship between OPM BG Ltd, UIC: 203470320, hereinafter referred to as the 'Provider' or 'We', as the operator of the website theboatsmarket.com, hereinafter referred to as the 'Platform' or the 'Website', and each user, hereinafter referred to as the 'User' of the Platform or 'You'.

1.2. Acceptance of the GTC

The use of the Platform, including browsing the content, registration, or posting advertisements, constitutes express acceptance of these GTC. If you do not agree with these GTC, please do not use the Platform.

1.3. Services

The Platform provides both a free service for posting, viewing, and searching for advertisements by individuals and companies, as well as paid services related to publishing an additional number of ads, advertisements, promotional articles, and other marketing services. The Provider is only an intermediary providing a technical means of communication between Users and is not a party to the transactions carried out through the advertisements.

2. Registration and User Profile

2.1. Registration

Registration may be required to post ads and/or use additional functionalities. The User is obliged to provide accurate and up-to-date data. The Provider reserves the right to refuse, suspend, edit, or terminate a registration if the data is incorrect, incomplete, or violates these GTC.

2.2. Profile Responsibility

The User bears full responsibility for all actions performed through their profile and for the protection of their password.

3. Rules for Posting Advertisements and Content

3.1. Prohibited Content

The User undertakes not to publish content that:

    3.1.1. Violates the rights of third parties (copyrights, trademarks, photographic material, etc.) without the express consent of the owner of such copyrights, and to provide a copy of such consent if requested by the PROVIDER.

    3.1.2. Is false, misleading, or fraudulent, including fake advertisements.

    3.1.3. Is illegal, threatening, discriminatory, offensive, obscene, or pornographic.

    3.1.4. Encourages violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, etc.

    3.1.5. Violates the applicable legislation of the EU and/or the State for which the advertisement is published.

3.2. Responsibility for Content

3.2.1. The User bears full and sole responsibility for the content of the advertisements published by them (texts, images, links) and for compliance with all legal requirements.

3.2.2. By accepting the GTC and publishing an ad on the platform, the User understands and accepts that the Provider has the right, but not the obligation, to advertise the ad at its discretion and where it deems fit, as well as to use the photos and information entered by the User for its own marketing purposes.

3.3. Right of Removal

The Provider has the right, but not the obligation, to remove, edit, or refuse the publication of any advertisement or other content that it believes violates these GTC or applicable legislation, without prior notice or justification.

4. Rights and Obligations of the Provider

4.1. Provision of the Service

4.1.1. The Provider strives to ensure the continuous operation of the Platform but does not guarantee that it will be error-free or accessible at all times. In any case, the Provider undertakes to fix all technical problems that it may encounter.

4.2. Limitation of Liability (Limitation according to the E-Commerce Directive 2000/31/EC)

 4.2.1. The Provider is not responsible for the content of the advertisements or for the actions/inactions of the Users.

 4.2.2. The Provider is not responsible for any damages, lost profits, or other consequences resulting from the use of the Platform or from transactions concluded between Users.

 4.2.3. The Provider is not obliged to monitor the content published by Users or to seek facts and circumstances indicating illegal activity, unless explicitly provided for by applicable law.

4.2.4. The Provider has the right, but not the obligation, to advertise the ad at its discretion and where it deems fit, as well as to use the photos and information entered by the User for its own marketing purposes.

5. Personal Data Protection (GDPR – Regulation EU 2016/679)

5.1. Privacy Policy

By using the Platform, You also accept our Privacy Policy, which is an integral part of these GTC. It describes what personal data we collect, for what purposes, and what your rights are as a data subject under the GDPR.

5.2. Direct Marketing

The Provider may use your data for direct marketing purposes (sending newsletters, promotions, etc.) only with your explicit consent or on another legal basis. You will always have the opportunity to withdraw your consent.

6. Termination

6.1. Termination by the User

The User may at any time request the deletion of their profile, which leads to the termination of the contract under these GTC.

6.2. Termination by the Provider

The Provider has the right to restrict and/or terminate the User's access to the Platform and/or delete their profile and advertisements immediately in the event of a violation of these GTC or applicable legislation.

7. Applicable Law and Dispute Resolution

7.1. Applicable Law

For all matters not settled in these GTC, the law shall be applied in accordance with the applicable law of the European Union.

7.2. Dispute Resolution

All disputes arising out of or in connection with these GTC shall be resolved through voluntary negotiations. If the dispute cannot be resolved in this way, it shall be referred for resolution to the competent court in the Republic of Bulgaria.

7.3. Online Dispute Resolution (ODR - Regulation EU No. 524/2013)

Users residing in the EU may use the European Commission's Online Dispute Resolution (ODR) platform, available at: https://commission.europa.eu

8. Amendments to the GTC

The Provider reserves the right to change these GTC at any time. Upon any change, the Provider will notify Users by posting on the Website and will publish the updated GTC with a new effective date. Continued use of the Platform after the changes take effect constitutes their acceptance.
